As well as my private practice as a business mediator and negotiator, I have been Head of the European Advisory Board for a Silicon Valley spin-off from eBay and PayPal called Modria Inc. The Modria team, now spread across offices in the USA, UK and India,  are part of Tyler Technologies. They designed, built and ran the dispute resolution systems pioneered by eBay and PayPal . Many negotiation researchers debating the merits of mediation vs arbitration wonder why alternative dispute resolution mechanisms are not more popular than they currently are. In Echtscheiding , I  was invited to advise in meeting the Committee of Legal Affairs and Human Rights of the Council of Europe on the impact of ODR on access to justice and human rights. The Committee produced a draft Resolution, since adopted by the Council, which calls on all 47 member States to promote the development and use of Online Dispute Resolution.

Child catastrophizing was measured using the Catastrophizing subscale of the Pain Response Inventory. The PRI is a 60-item questionnaire designed to assess children’s responses to pain [73]. It includes 13 subscales representing specific coping strategies such as problem solving, seeking social support, and stoicism.

Our own research has shown that children with parents who were more solicitous in response to their child’s symptoms had significantly higher school absentee levels for gastrointestinal symptoms than children whose parents were less solicitous [19]. Participant characteristics may influence the magnitude of treatment effects on outcomes [84]. We examined the potential moderating effects of parent education, parent and child age, gender, and race, and parent and child baseline anxiety (using the Brief Symptom Inventory [85] and the Multidimensional Anxiety Scale for Children [86]) on treatment outcomes. As a sensitivity analysis we ran models with age and sex included but, as expected, this did not change the results of the mediation analyses so ultimately these variables were not included in the mediation models. As a mediator, Mr. Kamminga is known for his thorough preparation, effective use of pre-mediation calls, his in-depth analysis of briefs and exhibits, and his determination to get matters resolved.

Parental beliefs about the threat posed by their child’s illness emerged as a significant mediator of the treatment effects of the intervention. Similarly, child catastrophizing also appeared to mediate changes in child-reported GI symptom severity, although these effects were in general smaller. These findings lend support to the cognitive-behavioral model tested in this study and suggest that targeting change in parent and child beliefs should be an important goal of programs aimed at improving child pain-related outcomes. The current results are thus consistent with a recent Cochrane review suggesting parental involvement in behavioral interventions increased effectiveness [61]. Mediators are intervening variables that are posited to change during or as a result of treatment and that provide a potential explanation of the causal sequences or mechanisms through which treatments affect outcomes [49, 50].
